Definition of safety requirements according to the F-Gas III regulation: requirements relating to the safe use of fluorinated greenhouse gases and non-organic refrigerants or products and equipment containing or relying on them, prohibiting the use of certain fluorinated greenhouse gases or their alternatives, including when contained in a product or equipment, at a specific location where they are to be used due to site and application specificities that are defined:
- a) in Union or national law; or
- b) in a non-legally binding act setting out the technical documentation or standards to be applied to ensure safety at that specific location, provided that they comply with Union law or applicable national law.
This particular point still needs to be clarified. This work is underway with the European Commission and professional associations.
Pending clarification, if an operator wishes to activate this clause, it should be a matter of common sense. The operator should keep all the information that led them to take this decision, have it ready for the authorities in the event of an inspection and give a copy to the operator.
